Execution of Contract for Sale and Purchase for a Permanent Easement from Plaza Paradiso, LLC, for Parcel 816 in the amount of $5,000.00.

Florida Statutes, Chapter 125.
Manatee County Comprehensive Plan Goal 9.5 addresses the potable water system.

Background Discussion
  • The Suburban System Phase III Project was approved in the FY 2008-2012 CIP.
  • Parcel 816 is a 300 square foot area of land  along the rear lot line at the Northwest corner of the parent tract being acquired for a permanent utilities easement in association with the above referenced project.
  • The Parent tract is improved with a single-story commercial retail use building.
  • On February 22, 2013, R&W Enterprises, Inc., appraised Parcel 816 at a value of $3,200.00.
  • After negotiations with the then owner, a contract was presented to and executed by the then owner.
  • Because of multiple outstanding issues, the contract was never presented to the Board of County Commissioners for approval, acceptance, and execution. 
  • In 2015, the property was sold to a third party.
  • Staff negotiated a new agreement with the new owner, Plaza Paradiso, LLC, who agreed to enter into a contract for the amount of $5,000.00, thereby avoiding additional costs of expert fees and litigation.
  • A cost avoidance analysis was done in 2016 to justify the negotiated contract price and is attached to this agenda item for review.
