Execution of Contract for Sale and Purchase for a Permanent  Easement from 57th Ave Rentals, LLC, for Parcel 814 in the amount of $9,800.00

Manatee County Comprehensive Plan Goal 9.5 addresses the potable water system. 

Background Discussion
  • The Suburban System Phase III Project was approved in the FY 2008-2012 CIP.
  • Parcel 814 is a 1,000 square foot area of land along the rear lot line of the parent tract being acquired for a permanent utilities easement in association with the above referenced project.  
  • The Parent tract is improved with a single-story commercial retail use building.
  • On February 22, 2013, R&W Enterprises, Inc., appraised Parcel 814 at a value of $7,800.00.
  • After further negotiations, the then owner agreed to and executed a contract in 2013 in the amount of $9,800.00. 
  • A cost avoidance analysis (attached) was done at that time to justify the negotiated contract price and was presented to the Board simultaneously with the contract on December 3, 2013.
  • The Board approved the contract and executed it.
  • That contract has since terminated due to the parties’ failure to close.
  • Post-termination of that contact, a change in ownership occurred and a new contract for Parcel 814 has been negotiated with the new owner.
  • The new owner, 57th Ave Rentals, LLC, agreed to the originally negotiated contract amount of $9,800.00 thereby avoiding additional cost of expert fees and litigation.
  • 57th Ave Rentals, LLC, also owns a second property that is affected by this project. The contract for that parcel (Parcel 815) will be presented under a separate agenda item.
