Reduction of Code Enforcement Fines for Jeffrey L Guy, Case CE2005120339

Action Requested
Motion to reduce the fines for this case to $500.00 plus $40.00 in recording fees, as previously recommended by the Special Magistrate on September 25, 2019, subject to the following conditions:
  1. The reduced fine shall be paid within 90 days or will revert to the original fine amount of $361,200.00.
  2. Recording fees shall be paid which total $40.00.
  3. Building and Development Services Department Director is authorized to sign satisfaction of liens if the reduced fines are paid.

Background Discussion
The owner, Jeffrey L. Guy, was cited for not having a building permits or Certificate of Occupancy.  

In 1997, Mr. Guy obtained a building permit to enclose his carport and florida room. Subsequently, the permit expired, but the work was completed. Code Enforcement issued a violation in 2005. Mr Guy stated that he was dealing with several personal issues that took some time to get through. His justification for consideration is outlined in the attached letter. The property is now in compliance.  Mr. Guy is respectfully requesting that the fines be reduced. 

Violation:  Sections 512 and 513 of the Land Development Code

  1. Notice of Violation was issued on December 30, 2005.
  2. The Special Magistrate Hearing was held on May 24, 2006.  The property owner was ordered to comply on or before July 21, 2006, or a minimum fine of $150.00 plus $100.00 per day would be imposed.  
  3. Complied July 14, 2011.
  4. Fines for this case total $361,240.00, which includes $40.00 in recording fees.
  5. The Special Magistrate Hearing was held on September 25, 2019.  The Magistrate determined that justification exists to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount to $540.00 to settle this case.  Staff supports the recommendation.
