Enabling/Regulating Authority

Land Development Code:  Chapter 9, Section 911.3, Public Hearing Requirements for Vacation of Streets, Roads and Other Appropriate Property. 

Florida Statutes: Chapter 177, Section 177.101 (3),  Vacation and Annulment of Plats Subdividing Land, and Chapter 336, Sections 336.09, et seq., Closing and Abandonment of Roads.

Background Discussion

On September 24, 2013, Resolution R-13-177, Regular Meeting Agenda Item #46 was approved in Open Session by the BCC.

Jean E. Button is requesting a portion of a platted 10 foot utility easement be vacated. It is described as a portion of Magnolia Manor River Section, Plat Book 11, page 70, located at 1803 54th Street East, and identified as PID 1433310008. 

The utility easement encroaches under a portion of the home creating title issues, which prevents the owner from successfully selling the property.

Jurisdictional Review by appropriate County Departments and Private Utility Agencies are approved without any objection. This vacation would serve only the applicants and complies with the technical requirements of the County's Land Development Code and pertinent Florida Statutes.

All application process expenses will be paid by the Applicant.  The application filing fee of $800 was paid by the Applicant on January 4, 2013.
