Reduction of Code Enforcement Fines for Betty Ann Waiters, Code Enforcement Case Number CE2001050311 - 2905 47th Avenue West, Bradenton

Action Requested

Motion to reduce the fines for this case to $150.00 (as previously recommended by the Special Magistrate on September 27, 2017), subject to the following conditions:

  1. The reduced fines shall be paid within 90 days or will revert back to the original fine amount of $1,500.00 for CE2001050311.
  2. Recording fees need to be collected, which total $28.00.
  3. Building and Development Services Department Director is authorized to sign satisfactions of liens if the reduced fines are paid.

Background Discussion

John Purdy, the current property owner, purchased the property on October 1, 2013, and is seeking a fine reduction as these fines were assessed against Betty Ann Waiters in 2001.

The property has changed ownership twice prior to the current owner acquiring the property. The property went through foreclosure (when Betty Waiters owned the property) and was sold on April 10, 2002, to the highest bidder at the foreclosure sale. That owner then sold the property to the current owner on October 1, 2013.

Violations: Junk vehicle (vehicle no tags and inoperable).

  1. Notice of Violation issued May 18, 2001.
  2. Special Magistrate Hearing was held on July 25, 2001 - Ordered to comply by August 17, 2001, or a minimum fine of $150.00 plus $25.00 per day would be imposed to a maximum amount of $1,500.00.
  3. Compliance date was October 13, 2003.
  4. Fines for the case total $1,500.00 plus $28.00 recording fees to settle the case.

Special Magistrate Mitigation hearing was held on September 27, 2017. The Magistrate determined that justification exists to reduce the total fine amount and to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount which totals $1,500.00 to $150.00 plus $28.00 recording fees to settle the case. Staff recommends approval.
