Action Requested

RECOMMENDED MOTION:

Based upon the staff report, evidence presented, comments made at the Public Hearing, the action of the Planning Commission, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, as conditioned herein, I move to APPROVE Manatee County Ordinance No. PDR-17-18(Z)(G); APPROVE a General Development Plan with Stipulations A.1-A.8, B.1-B.6, C.1-C.4, and D.1; GRANT Special Approval for a project: 1) exceeding a gross density of 2.0 dwelling units per acre in the RES-3 FLUC, 2) exceeding a net density of 3.0 dwelling units per acre in the RES-3 FLUC, 3) adjacent to a perennial stream, 4) within the Watershed Protection Evers Overlay District, and 5) within the Special Treatment Overlay District; ADOPT the Findings for Specific Approvals; and GRANT Specific Approval for alternatives to Land Development Code Sections 402.7.D.5 (Planting alternative within the northwest portion of the greenbelt buffer),  1001.4.D.1 (Cul-de-sac exceeding 800 feet in length), 1005.7.D.2 (Backing onto a public or private lane for multi-family dwelling units), and 1005.7.E (Allow multiple stacking of spaces for multi-family units); as recommended by the Planning Commission.

Background Discussion

• Ms. Darenda Marvin, AICP, with Grimes Goebel, et al, agent of the property owner, is requesting approval of a:
- Rezone of approximately 42.3 acres on the eastern portion of a ±200.68-acre site (158.38 acres are already zoned PDR) from A-1/WP-E/ST (Suburban Agriculture/Watershed Protection Evers/Special Treatment Overlay Districts) to the PDR (Planned Development Residential/Watershed Protection Evers/Special Treatment Overlay Districts).

• General Development Plan for 600 residential units, including single-family detached, single-family semi-detached, single-family attached, and multi-family.

• The project site is vacant and located 1,350 feet east of Lockwood Ridge Road (45th Street East), west of the Evers Reservoir, and north of Honore Avenue (Bradenton, Manatee County).

• The entire site is designated RES-3 (Residential-3), and its eastern portion is partially located in the Coastal Planning Area (Evacuation Level C).  The General Development Plan proposes:
- A gated community with two (2) full main access points and one (1) emergency access along Honore Avenue, a planned thoroughfare (4-lane arterial roadways per the Future Circulation Map of the Comprehensive Plan). An optional limited access (right in/right out) is shown to serve future recreational area/potential residential area. 
- The proposal includes two major components:
• 70.24 acres of open space (lakes, buffers, and native habitat preservation) which represents 35% of the total project area in compliance with the minimum requirement for a Planned Development Residential within the Watershed Protection Evers Overlay District, and
• 130.44 acres subject to residential development comprising three areas: two residential sectors to the east and west of the site (approximately 78.89 acres), and a 51.55-acre central area designated to the future location of amenities and recreational areas, as well as optional residential areas.    
- Streets will be private, and lots will be located on both sides of 50-foot wide internal streets. All streets are shown with 2-lanes (24 feet pavement width), and sidewalks on both sides. No inter-neighborhood tie is proposed since the development will be a private community.
- The minimum lot sizes are 4,000 sq. ft. (35 feet wide) for single-family detached, 3,500 sq. ft. (30 feet wide) for single-family semi-detached, and 2,400 sq. ft. (20 feet wide) for single-family attached.  The proposal includes the option to determine at Preliminary Site Plan/Final Site Plan the number of units by type (single-family and multi-family).
- A gross and net density of 2.99 and 5.82 dwelling units per acre respectively, in compliance with the provisions of the Comprehensive Plan for a project within the RES-3 FLUC (maximum of 3 du/acre gross and 6 du/acre net).
- The Preliminary Site Plan proposes a 20-foot wide roadway buffer along Honore Avenue, 15 feet greenbelt buffer along to the north, east, and west property boundaries, except for a minimum 50-foot wide wetland buffer along the northwest corner of the site.
- As “neighborhood focal point”, the General Development Plan proposes optional recreational amenities that may include multi-use field, trails, and dog park.  The total acreage and types of amenities will be determined at Preliminary Site Plan/Final Site Plan, and will be located within the 51.55 acres central parcel previously mentioned.
- Prior to the Preliminary/Final Site Plan approval, an Emergency Preparedness Plan will be submitted for review and approval to the Manatee County Emergency Management Division of the Public Safety Department. 

• Special Approval is required to be granted by the Board of County Commissioners for a project:
- exceeding a gross and net density of 2.0 dwelling unit per acre and 3.0 dwelling units per acre, respectively, in the RES-3 FLUC,
- adjacent to a perennial stream, and
- within the Watershed Protection Evers and the Special Treatment Overlay Districts.

• Additionally, applicant request Specific Approval for an alternative of LDC Sections:
- 402.7.D.5 - Planting alternative within the northwest portion of the greenbelt buffer.
- 1001.4.D.1 - Cul-de-sac exceeding 800 feet in length (one instance on the western portion of the site)
- 1005.7.D.2 - Backing onto a public or private lane for multi-family dwelling units.
- 1005.7.5 - Allow multiple stacking of spaces for multi-family units.

• The purpose of the Special Approval and Specific Approval request is satisfied by the proposed project’s design. Staff recommends APPROVAL with stipulations.

• On April 12, 2018, by a vote of 5 – 1, the Planning Commission recommended approval. Mr. Horrigan voted nay stating nothing in the area should be approved until traffic issues are resolved. Mr. Rutledge was absent.
