Action Requested

Motion to reduce the fine for case number CE2007030020 totaling $350,350.00 to $3,000.00 (as previously recommended by the Special Magistrate on April 26, 2017), subject to the following conditions:

  1. The reduced fine shall be paid within 90 days or will revert back to the original fine amount of $350,350.00 for case number CE2007030020.
  2. Recording fees need to be collected, which total $20.00.
  3. Building and Development Services Department Director is authorized to sign satisfactions of liens if reduced fines are paid.

Background Discussion

Raul Guerrero and Maribel Munoz (property owners) are seeking a fine reduction. The property owners applied for a building permit on July 10, 2007, which was approximately one month prior to the compliance date ordered by the magistrate. The property owners did not follow through with the permit process and were reminded recently of this discovery. The property owners immediately resolved it by renewing the permit and providing the necessary paperwork (engineers letter certifying the work) to finalize their permit. The property owners have indicated that they have spent approximately $10,500.00 to resolve the issue.

  1. Violation: Certificate of Occupancy was not obtained.
  2. Notice of Violation was issued on 3/7/2007.
  3. Special Magistrate Hearing was on 6/272007 - ordered to comply or $150.00 plus $100.00 per day would be imposed.
  4. Compliance date was 3/20/2017.
  5. Fines for the case total $350,350.00 plus $20.00 recording fees to settle the case.
  6. Special Magistrate Mitigation hearing was held on 4/26/2017.  The Magistrate determined that justification exists to reduce the total fine amount and to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount totaling $350,350.00 to $3,000.00 plus $20.00 recording fees to settle the case.  Staff recommends approval.
