Action Requested

Authorization for Chairman to execute the following documents:

  • Credit Authorization CA-17-01(T)
  • Final Authorization of Transportation Impact Fee Credit in the amount of $182,892.83 for eligible right-of-way dedication and construction of stormwater retention facilities for 49th Avenue East, per Impact Fee Credit Authorization CA-17-01(T).

Background Discussion

Chapter 11, Section 1106, of the Manatee County Land Development Code provides for authorization by the Board of County Commissioners for Impact Fee Credits for contributions, payment, construction, or dedications made to Manatee County against applicable components of the impact fees.

As part of the development of the Willow Walk community in northwestern Manatee County, OK Willow Walk, LLC, made the following creditable contributions:

  • Dedicated right-of-way for 49th Avenue East
  • Constructed stormwater retention facilities

The required improvements have been completed and verified by Public Works staff.  The creditable construction costs have been reviewed and verified by Public Works staff, and the value of creditable land dedications have been reviewed by Property Management staff.  The amount of transportation impact fee credit which staff has determined that OK Willow Walk, LLC, is qualified to receive is outlined below:

• 49th Avenue East Right-of-Way Dedication        $130,500.00
• Stormwater retention construction                     $ 52,392.83
Total Credit                                                       $182,892.83

Note that this dedication was made in Impact Fee Transportation Benefit District "NW"
