Ordinance 15-37 - Issuance of COPCN

In December 2015, the Manatee County Board of County Commissioners approved Ordinance 15-37 relating to the authorization of private medical transportation services within the county and issuance of Certificate(s) of Public Convenience and Necessity (COPCN).
This Ordinance established a formal application and approval process for the issuance of up to two (2) COPCNs for private entities to provide interfacility medical transports in the county.
A notice that applications from entities wishing to provide this service was announced and posted to the Manatee County website on February 1, 2016. Applications were accepted until March 1, 2016. Three applications were received. The applications were from:
West Coast Southern Medical Service, Inc.
The current COPCN holder, based in Bradenton, FL and providing interfacility medical transportation services in Manatee County since 1980
Ambitrans Medical Transport, Inc.
A Florida-based company, headquartered in Charlotte Harbor, FL since 1983, currently providing services in Charlotte, Collier, Lee, and Sarasota Counties
A Flint, MI company with a Bradenton, FL business address, not currently operating or licensed in the state of Florida
These applications were reviewed by staff based on the requirements set forth in Ordinance 15-37, and the Review Committee's findings were presented to the County Attorney’s Office.
Based on this formal review process, staff findings and recommendations include:
· Manatee County has experienced a tremendous growth in population which has led to an increased call volume for the Manatee County EMS Division. With this increase in call volume comes the demonstrated need for additional interfacility transport providers.
· Many other counties and local governments throughout Florida issue Certificate(s) of Public Convenience and Necessity to more than one service provider.
Therefore, it is staff’s recommendation that current need exists to issue two (2) COPCNs in Manatee County.
Based on the applications submitted, review of those applications, and compliance with the requirements set forth in Ordinance 15-37, it was found that only two of the three submissions met the requirements and were in compliance with the Ordinance’s application process.
Therefore, staff recommends that a COPCN be issued to Ambitrans Medical Transport, Inc.
Further, based on existing need, staff recommends the issuance of a one (1) year provisional COPCN to the current certificate holder West Coast Southern Medical Service, Inc. The issuance of a provisional COPCN to West Coast Southern Medical Service, Inc. is purposed to provide the opportunity for West Coast Southern to become compliant with the provisions required in Ordinance 15-37 that were not required when the current COPCN was issued to West Coast Southern Medical Service, Inc. West Coast Southern and Ambitrans Medical Transport, Inc., have a demonstrated positive working relationship in Sarasota and Charlotte Counties and staff feels this model will provide the highest level of service possible to Manatee County.
