Reduction of Code Enforcement Fines for Sandra Linn Baxter PIN#5453500000, 1004 50th Avenue Terrace West, Bradenton

Action Requested

Motion to reduce fines for case number CE2002100396 totaling $235,850.00 to $1,000.00 (as previously recommended by the Special Magistrate on January 25, 2017), subject to the following conditions:

  1. The reduced fines shall be paid within 90 days or will revert back to the original fine amounts of $235,850.00.
  2. Recording Fees need to be collected, which total $20.00.
  3. Building and Development Services Department Director is authorized to sign satisfactions of liens if reduced fines are paid.

Background Discussion

Ryan Felts is the current property owner (mobile home). Ryan's grandmother (Anne Felts / deceased) purchased the property from Sandra Baxter, who the lien was against, and was unaware of the lien as Sandra did not disclose this information. Ryan, nor his grandmother, were the property owners at the time of the violation. 

Approximately $5,000.00 was spent to abate the violation. Ryan Felts (current property owner) is requesting that these fines be mitigated to $1,000.00 plus $20.00 recording fee.

Below is a brief synopsis regarding the case history:

  1. Violation: Constructing an addition to a mobile home without the required permits.
  2. Notice of Violation issued:  10/24/2002 and 11/20/2002
  3. Special Magistrate Hearing: 1/22/2003 - ordered to comply or a $150.00 fine plus $100.00 per day would be imposed.
  4. Complied:  8/6/2009 - 2,358 days.
  5. Fines total $235,850.00 plus $20.00 recording fee.
  6. Property owner offered a total of $1,000.00 plus $20.00 recording fee to settle this case.
  7. Special Magistrate Mitigation Hearing was 1/25/2017.  The magistrate determined that justification exists to reduce the total fine amounts and to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amounts totaling $235,850.00 to $1,000.00 plus $20.00 recording fee to settle this case. Staff supports the recommendation.
