  • Execution of Contract for Sale and Purchase for a Warranty Deed with 2014-1 IH Borrower L.P. in the amount of $44,000.00.

Enabling/Regulating Authority

Florida Statutes, Chapter 125 and Chapter 127, and Manatee County Comprehensive Plan Goal 5.1 addresses the safety and efficiency of forecasted vehicular demands.

Background Discussion
  • The 45th Street East road improvement project from SR 70 to 44th Avenue East was approved in the FY 2013-2017 CIP 382-6025662.
  • Parcel 113 is a partial acquisition consisting of a 627 square foot strip along the frontage of 45th Street East.
  • On February 25, 2015 Appraiser Shawn E. Wilson, MAI, of Compass Real Estate Consulting, Inc., determined the value of the area for acquisition at $43,500.00
  • The appraisal value for the take consists of land at $3,800.00, improvements at $4,800.00, net cost to cure at $1,500.00, and severance damages at $33,400.00.
  • Improvements within the acquisition area include shrubs, sod, and irrigation. A cost to cure is required to modify the irrigation and install new landscaping.
  • A settlement was reached at $43,500.00 to include $500.00 for legal fees totaling an acquisition cost of $44,000.00.
  • The negotiated settlement eliminates possible additional litigation expenses and expert witness fees.
