Reduction of Code Enforcement Fines for Joanne Eddy, Code Enforcement Case Number CE2015050169

Action Requested

Motion to reduce the fines for this case to $1,000.00 (as previously recommended by the Special Magistrate on May 25, 2016), subject to the following conditions:

  1. The reduced fines shall be paid within 90 days or will revert back to the original fine amount of $20,400.00 for CE2015050169.
  2. Recording fees need to be collected, which total $20.00.
  3. Building and Development Services Department Director is authorized to sign satisfactions of liens if the reduced fines are paid.

Background Discussion

Code Enforcement Case CE2015050169, 1011 42nd St W, Bradenton, FL. 34205 (PI #3975600002).  Below is a brief synopsis regarding this case:

  1. Violation: Swimming pool not maintained in a clean, safe, and sanitary condition and not in working order.
  2. Notice of Violation issued 05/14/2015.
  3. Special Magistrate Hearing 8/26/2015. Ordered to comply by 9/18/2015 for Section 2-9-107(c)(1) or a $75.00 per day fine would be imposed; and ordered to comply by 9/18/2015 for Section 2-9-107(c)(2) or a $75.00 per day fine would be imposed.
  4. Section 2-9-107(c)(1) was complied 2/2/2016.
  5. Section 2-9-107(c)(2) was complied 2/2/2016.
  6. Total fine $20,400.00 plus $20.00 recording fee.
  7. The personal representative (Edward Eddy) of the estate of Joanne Eddy offered $1,000.00 plus $20.00 recording fee.
  8. Special Magistrate Mitigation Hearing 5/26/2016. The Magistrate determined that justification exists to reduce the total fine amount and to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount to $1,000.00 plus $20.00 recording fee.

The property owner passed away on January 6, 2016. Edward Eddy (brother and representative of the estate) worked with the County to achieve compliance and stop the fines.
