Capital Contribution Agreement for The Oasis at Lakewood Ranch, LLC

Authorization for the Chairman to execute "The Oasis at Lakewood Ranch, LLC Agreement for Capital Contribution Towards Lorraine Road Improvement" agreement.
Section 2-31-5(D) of the Manatee County Code of Ordinances
Manatee County has an active CIP Project at Lorraine Road and SR70 to improve the intersection. As part of the intersection improvement, staff reached out to all active development projects (4 entities) at the intersection where the ultimate CIP design would benefit each of the proposed development project entities. This is a public / private partnership project involving four different private partners. This project deals with Lorraine Road Improvements on both sides of SR 70. We also met with FDOT to coordinate the improvements on Lorraine Road with their upcoming improvement project on SR 70 at this intersection. County's CIP project utilizes stormwater pond location owned by FDOT in this area which makes FDOT the fifth partner on this project.
The Oasis at Lakewood Ranch, LLC is one of the private partners on this project that is proposing to construct a multi-family development requiring access to Lorraine Road, east side of Lorraine Road and North of State Road 70. The Developer's project includes a right-turn deceleration lane for the project entrance on Lorraine Road (the "Site-Related Improvements"). In order to provide for the construction of the "Site-Related Improvements" as a component of the County CIP project on Lorraine Road, to be located at the boundary of the Developer's Project after the widening of Lorraine Road, the Developer desires to dedicate the necessary right-of-way and to contribute the funds necessary for the site related Improvements, in-lieu of constructing the site- related improvement on its own property with their own funds.
It is anticipated that the Oasis at Lakewood Ranch site improvements will be completed before the County's CIP on Lorraine Road Improvements is scheduled to begin, which means the turn lanes referenced above, if constructed by Oasis at Lakewood Ranch, would have to be removed as part of the road widening and reconstructed in the right location.
As a result, the Developer has agreed:
