Background Discussion
Chapter 8, Section 807 of the Manatee County Land Development Code provides for authorization by the Board of County Commissioners for Impact Fee Credits for contributions, payments, construction, or dedications made to Manatee County against applicable components of impact fees.

Manatee County Ordinance PDMU-06-30(G)(R2), Lakewood Centre, stipulated that, "prior to or concurrent with each Final Plat approval, right-of-way for the adjacent roadways ... shall be dedicated."  The Creekside Apartments at Lakewood Ranch project is a Lakewood Centre development that applied for, and received, its final site plan approval (FSP-13-07) in 2013.  As part of that final site plan approval, the project developer was required to dedicate a 0.2967-acre section of right-of-way along Lakewood Ranch Boulevard to Manatee County.

Tom Cavanaugh, owner of PAC Land Development and owner/developer of the Creekside Apartments at Lakewood Ranch property, has dedicated the required segment of
right-of-way.  This dedication has been found by County staff to be eligible for credit against the road component of the County's impact fees.  The Creekside Apartments project is located on Lakewood Ranch Boulevard, which is in Impact Fee Benefit District "SE."  

The total value of the creditable land dedication has been determined to be $55,800.  

The right-of-way will be acquired by warranty deed today, in a separate agenda item being submitted by the Property Management Department’s Land Acquisition Division.  Property Management's agenda package includes dedication acceptance paperwork to be executed by the Board of County Commissioners of Manatee County.
