Disinterment at New Memphis Cemetery

Action Requested
Authorize the disinterment of the cremated remains of Samuel Mull from the county-owned New Memphis Cemetery by a licensed funeral director for final disposition elsewhere and in accordance with state law.

Enabling/Regulating Authority
Chapter 125 and Section 497.384, Florida Statutes, and Rule 69K06.007, Florida Administrative Code.

Background Discussion

Mr. Samuel Mull was laid to rest through Manatee County's indigent burial program in February 2015.  At the time of his interment, there were no known relatives or representatives to claim the remains.  Since that time, a Personal Representative to Mr. Mull's estate has been appointed (November 2015) and is seeking to have the remains disinterred and relocated to another location.  A licensed funeral director has agreed to perform the disinterment in accordance with state law and at no cost to the County.  The disinterment cannot be performed without written authorization from the individual or individuals who currently own the burial rights for the burial space (the Board of County Commissioners, on behalf of Manatee County).

Mr. Elliot, the representative for  Mr. Mull's estate has submitted a check for reimbursement of the $535 that the County had spent on the burial.
