Reduction of Code Enforcement Fines for Pearson Auto Transport, Inc., and Mark Rudek and Gail Rose, Code Enforcement Case Number CE2004010054

Action Requested

Motion to reduce the fines for this case to $1,000.00 (as previously recommended by the Special Magistrate on May 25, 2016), subject to the following conditions:

  1. The reduced fines shall be paid within 90 days or will revert back to the original fine amount of $342.250.00 for CE2004010054.
  2. Recording fees need to be collected, which total $20.00. 
  3. Building and Development Services Department Director is authorized to sign satisfactions of liens if the reduced fines are paid.

Background Discussion

Code Enforcement Case CE2004010054, 3522 US 41 N (formerly known as 3612 US 41 N), Palmetto, FL. 34221 (PI #2310400003). Below is a brief synopsis regarding this case:

  1. Violation:  Fence and steel structures with vinyl coverings were erected without the required building permits.
  2. Notice of Violation issued 1/8/2004.
  3. Special Magistrate Hearing 6/22/2005. Ordered to comply by 9/23/2005 for Section 512 or a $150.00 minimum fine and $100.00 per day fine would be imposed.
  4. Complied 2/5/2015.
  5. Total fine $342,250.00 plus $20.00 recording fee.
  6. Property owner offered $1,000.00 plus $20.00 recording fee.
  7. Special Magistrate Mitigation Hearing 5/25/2016. The Magistrate determined that justification exists to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount to $1,000.00 plus $20.00 recording fee.

Note: Compliance with this case took longer due to the use of outdoor storage not being allowed and site plan approval being required.  A building permit could not be issued for the structure until a code amendment and site plan approval had been obtained.  This process started in 2006 and was completed in 2011.
