Background Discussion

The applicant received preliminary approval of Final Site Plan FSP-14-66 by written letter dated February 2, 2015, from Bernard Salmon, Planner, Building and Development Services Department. 

A condition of the preliminary approval requires written documentation that access has been granted over a portion of  a platted non-vehicular ingress egress easement prior to construction. 

The applicant, BW 70 Lorraine, LLC, is requesting vacation of a 326 square foot portion of the platted non-vehicular ingress/egress easement area at Lot 1, Lorraine Corners Southeast.

Lorraine Corners Southeast is a commercial subdivision plat that was recorded in Plat Book 52, Pages 197 through 200, located at 14510 State Road 70 East, Bradenton, Florida 34202.

Jurisdictional reviews by appropriate county departments have been notified of the applicants request and had no objection.  Private utilities serving the area have been notified of the applicants request with no objection.  However, Verizon placed a condition that the applicant obtain a 10 foot wide easement to Verizon Florida, LLC. 

The applicant has requested execution of a Communication Easement for the 10 foot wide area by an authorized representative at Verizon Florida, LLC.

The vacation application complies with the Florida Statutes and the county's land development code. The $800 required filing fee has been paid by the applicants. All other expenses associated with the vacation process will be paid by the applicant.
