Background Discussion

On September 18, 2014, the Board of County Commissioners adopted the FY2014-2015 budget that included funding for Manatee Children's Services, Inc., Child Welfare Forensic Medical Examinations.

An Agreement for Non-Profit Agency Services was executed on October 22, 2014.  Reimbursement for forensic medical examinations was based on the Medicaid Provider Fee Schedules for Physicians, Advanced Registered Nurse Practitioners, and Physician Assistants and was subject to change if new Medicaid Provider Reimbursement Schedules were to occur during the term of the Agreement.

At the time the Agreement was executed, changes in the Medicaid Provider Reimbursement Schedules were not anticipated by the County or Agency. 

New Medicaid Provider Fee Schedules came into effect January 1, 2015, with significantly (68%) lower reimbursement rates for the Procedural Terminology Codes (CPT) in this Agreement.  County decreased the reimbursement rates to correspond with the most current Medicaid Provider Reimbursement Schedules effective January 1, 2015, in compliance with the language in the Agreement. 

On May 1, 2015, the Agency reported the sudden loss of anticipated revenue created a financial hardship and requested an Amendment to the Agreement to restore the rate of payment to the level of reimbursement in effect at the time of its execution.

An amendment to the FY2014-2015 Agreement for Non-Profit Agency Services is needed at this time to grant the Agency's request and provide an appropriate funding mechanism for the remainder of the current fiscal year.

This amendment affects only the reimbursement for units of service for the period of May 1, 2015, through September 30, 2015.
