Extend Term of the County's Four Cent Local Option Gas Tax

Motion to adopt proposed Ordinance No. 13-29 amending Article III of Chapter 2-29 of the Manatee County Code of Ordinances to extend the term of the County's four cent local option fuel tax for a period of 30 years.

Background Discussion

In 1983, Manatee County adopted Ordinance 83-27, imposing a four cent local option gas tax with a five year expiration.  In 1986, Manatee County adopted Ordinance 86-29, which extended the four cent local option gas tax for a period of 30 years commencing September 1, 1983.  The ordinance for the four cent local option gas tax expires August 31, 2013. 

Florida Statute 336.025 provides that the county may extend the term of the local option gas tax pursuant to an Ordinance enacted by an affirmative vote of a majority of the Board, provided the period of extension does not exceed 30 years. 

This agenda item will renew the four cent local option gas tax for a period of thirty years commencing September 1, 2013 and expiring August 31, 2043.

Over the years, the four cents of local option gas tax has been used for road construction and repairs as well as other Public Transportation uses authorized under Florida Law.  More recently, a large portion of this revenue has been used to pay debt service on the 2004 Transportation bonds, for which debt service payments are required to continue through FY2020.  In addition, as property tax revenues have declined in recent years, availability of this revenue source has enabled us to continue Transit service without reductions.

Approximately 20% or more than $1 million of the revenue is shared with municipalities, which makes it a substantial source of funding for municipal road construction and repairs.
