Extend Term of the County's Five-Six Cent Local Option Fuel Tax

Motion to adopt proposed Ordinance No. 15-28 amending Section 2-29-32 of the Manatee County Code of Ordinances to extend the term of the County's five-six cent local option fuel tax for a period of 30 years.

Background Discussion

In 1985, Manatee County adopted Ordinance 85-21, imposing a Five (5) and Six (6) cents local option gas tax effective from September 1, 1985, until the General Election of 1986. In 1986, Manatee County adopted Ordinance 86-29, which amended Ordinance 85-21 to extend the Five and Six cents local option gas tax for the maximum term permitted by law. Ordinance 86-29 extends the levy of the fifth and sixth cents local option gas tax from the General Election of 1986 to a term of 30 years commencing September 1, 1985. Ordinance 86-29 for the Five and Six cents local option gas tax expires August 31, 2015.

Florida Statute 336.025 provides that the county may extend the term of the local option gas tax pursuant to an Ordinance enacted by an affirmative vote of a majority of the Board, provided the period of extension does not exceed 30 years.

This agenda item will renew the Five and Six-cents local option gas tax for a period of thirty years commencing September 1, 2015. Over the years, the Five and Six cents of local option gas tax has been used for road construction and repairs as well as other Public Transportation uses authorized under Florida Law. In addition, since property tax revenues have not fully rebounded, availability of this revenue source has enabled us to continue Transit service without reductions.

Approximately 21% or more than $600,000 of the revenue is shared with municipalities, which makes it a substantial source of funding for municipal road construction and repairs.
