Adoption of Resolution R-13-014, declaring a public hearing on February 12, 2013, at 9 a.m., or as soon thereafter, for the purpose of considering and acting upon an application to vacate 12th Street Court East.

BACKGROUND: The Manatee County Public Works Department would like to initiate an application to vacate a portion of an improved platted 40 foot right of way of 12th Street Court East (Lee Street), located between 26th Avenue East and 30th Avenue East, containing 4,000 square feet more or less, and platted in Southland Terrace, Plat Book 4, page 43, of the Public Records of Manatee County, Florida.
PURPOSE OF REQUEST: The Public Works Department would like to vacate the12th Street Court East right of way, located within the perimeter of the Public Works 26th Avenue East Complex. This request is required by Chapter 316.204, Florida Statutes, Obstruction of public streets, highways, and roads, prior to the planned repair and replacement of perimeter fencing which will include automated gates at all compound access points. Included within the scope of the perimeter fence project are automated access gates which will be equipped with frequency receivers allowing emergency vehicles automated access to the facility after hours when gates are closed. Additional fob type transmitters will be available for those requiring frequent access to the compound after normal working hours. This will enhance the security for this facility.
COUNTY AND UTILITY COMPANY REVIEW: Jurisdictional review by other appropriate County Departments and Private Utility Companies serving the location to be vacated have been notified of the applicants intention to file a vacation, and have no objection. This vacation would serve only the applicant. The vacation application complies with the technical requirements of the County's Land Development Code and pertinent Florida Statutes.
FISCAL IMPACT: All expenses associated with the subject application, its approval, and recording will be borne by the Applicants. Since this is a County initiated vacation request there is no application filing fee.
