Background Discussion

The Manatee County Land Development Code, Manatee County Code of Ordinances and Laws of Florida contain requirements pertaining to standards and procedures for maintenance of property and structures within the unincorporated area of the county.

Staff from the Building and Development Services Department have proposed a new code to consolidate and update the standards and procedures for maintenance of property and structures.  The County Attorney's Office drafted Ordinance No. 15-10 to incorporate the existing regulations as well as new requirements.

Significant provisions of the ordinance include the following:

  • The standards apply to all existing property and structures (residential and nonresidential) in the unincorporated area of the county, with the exception of designated historic structures.
  • In the event of conflict with any county ordinance (including the Land Development Code), the most restrictive requirement prevails.
  • An administrative official designated by the county administrator is responsible for administration and enforcement of the standards.
  • The definition of junk vehicles has been replaced by inoperable vehicles and revised to cover vehicles that are not registered or fail to properly display a license plate.
  • Nuisance conditions are defined and prohibited on all property.
  • Limitations are specified for minor service and repair work on motor vehicles on residential property.       
  • New standards are established for all structures and appurtenant structures (garages, storage sheds, fences) that address maintenance of exterior surfaces, walls, roofs, overhangs, doors and windows.
  • Vacant structures must be secured from entry by unauthorized persons.
  • Maintenance of swimming pools encompasses water clarity and quality requirements. 
  • The following regulations have been imported from the Land Development Code:
    • Outdoor storage on residential property;
    • Outdoor display on nonresidential property;
    • Structure numbers;
    • Parking for commercial vehicles;
    • Parking for restricted vehicles, including boats in the Cortez Fishing Village; and
    • Removal of inoperable vehicles.
  • Enforcement procedures refer to Florida Statutes for code enforcement, the Manatee County special act for lot clearing, and the Code of Ordinances for unsafe structures.
