ADOPT Resolution R-15-019.

Enabling/Regulating Authority

Florida Statutes 336.09, Closing and Abandonment of Roads 336.12, Authority; and 336.10, Closing and Abandonment of Roads, Publication of Notice.

Manatee County Land Development Code Section 91; Public Hearing requirements for Vacation of Streets, Roads, and other Appropriate Property.

Background Discussion
  • This request is subsequent to the acceptance of Resolution R-15-018 vacating an unimproved road right-of-way by a an Exchange of Property Agreement and Conveyance between Manatee County and Neal Communities of Southwest Florida, LLC also on the January 27, 2015 consent agenda by the County Attorney's Office.
  • On March 6, 2014 a Reimbursement Agreement exchanging property for the realignment of Tuttle Avenue was executed between Manatee County and Neal Communities of Southwest Florida, LLC.
  • Jurisdictional review by appropriate County departments and private utilities serving the area have been notified and have no objection to the applicant’s request.
  • The application complies with the Florida Statutes and the county’s land development code.
  • The $800.00 required filing fee has been paid and all other expenses associated with the vacation process will be paid by the applicant.
