Display Racks on County Beach Property

The Parks Code (found at Chapter 2-24 of the County Code) does not provide specific regulation of the types of display/distribution racks in question. The only provision of the Parks Code arguably applicable is 2-24-8, which prohibits posting signs, distribution of handbills, circulars, or advertisements, and vending in County parks without a County franchise license. Florida Statutes 705.101 through Florida Statutes 705.104 provide the statutory scheme whereby a county government may obtain the lawful removal and possible sale or disposal of property abandoned on its property.
To have initial discussion, provide a picture of the problems, provide a discussion of the legal and administrative limitations to regulation and enforcement, propose a general policy direction concerning uniform newspaper rack systems to attempt to address the concerns over the beach news rack placement issue.
