Action Requested
Authorization for Chairman to execute Credit Authorization CA-14-04 (T) for payment in lieu of construction of the Port Harbour Parkway Extension, per Amended and Restated Local Development Agreement executed on September 14, 2014, between Lennar Homes, LLC, Manatee Land Investors, LLC, Upper Manatee 288 LLC, and Manatee County. 

Authorization for Chairman to execute Final Authorization of Road Impact Fee Credit in the total amount of $2,149,201.78 per Credit Authorization CA-14-04 (T).

Background Discussion
Chapter 8, Section 807, of the Manatee County Land Development Code provides for authorization by the Board of County Commissioners for Impact Fee Credits for contributions, payments, construction, or dedications made to Manatee County against applicable components of impact fees.  

Under the terms of amended and restated Land Development Agreement 08-08 for Heritage Harbour (said amendment/restatement having been executed by Lennar Homes, Manatee Land Investors, LLC, Upper Manatee 288 LLC, and Manatee County on September 14, 2014), Lennar Homes was required to pay to Manatee County the sum of $2,299,201.78 for the extension of Port Harbour Parkway.  The amended Land Development Agreement further stipulated that Lennar would immediately receive road impact fee credits in exchange for this payment, less $150,000.00 (LDA Article II, Section 2.1., Paragraph D.).    

Lennar Homes wired a $2,299,201.78 payment to Manatee County on December 17, 2014.  Lennar is, therefore, now entitled to road impact fee credits in the amount of $2,149,201.78.  They may use these credits in the Heritage Harbour development for road impact fees on any permits applied for on or after December 21, 2011.
