Enabling/Regulating Authority

Manatee County Land Development Code section 911, Public Hearing requirements for Vacation of Streets, Roads and other Appropriate Property.

Florida Statutes Section 336.09, and 336.10 et seq., Closing and Abandonment of Roads.

Background Discussion
  • The applicant, Neal Communities of Southwest Florida, is requesting vacation of 150,354 square feet of unimproved right-of-way.   This vacation is needed as a result of a Reimbursement Agreement between Manatee County and Neal Communities of Southwest Florida that was approved by the Board on March 6, 2014 providing for an exchange of properties for the purpose of realigning Tuttle Ave.
  • This is a tract of land lying within Section 21 and 28, Township 35S, Range 18E, located south of Whitfield Avenue, Bradenton, Florida, conveyed to Manatee County for the realignment of Tuttle Avenue. 
  • Jurisdictional reviews by appropriate county departments and private utility companies serving the location to be vacated have been notified of the intention to file a vacation and have no objection.
  • The vacation complies with the technical requirements of the Manatee County Land Development Code and pertinent Florida Statutes.
  • All expenses associated with the subject vacation will be paid by the applicant.
  • Manatee County's application filing fee of $800 has been paid.
