Mitigation of Impacts for Construction of Bridge Over Manatee River at Fort Hamer Road

Action Requested

Authorization for the Chairman to execute the Mitigation of Impacts of Construction of Bridge over the Manatee River at Fort Hamer Road Agreement between Samuel L. Caruso and Manatee County for the purchase of a vessel impacted by the height restriction of the Ft. Hamer Bridge.

Authorization for the chairman to endorse the title for transfer of property to Manatee County.

Florida Statute, Chapter 125,  Section 125.01- Powers and Duties.

Background Discussion
  • The County will be constructing a new bridge across the Manatee River connecting Upper Manatee River Road to Ft. Hamer Road.
  • The bridge will be constructed with a maximum height of 26 feet.
  • The owner of a residential home located at 12005 Upper Manatee River Road owns and moors a Hunter 25 sailboat (vessel) with a mast height of 36 feet.
  • After completion of the new bridge the vessel will no longer be  able to operate west of the new bridge.
  • The US Coast Guard has conducted an evaluation of impacts resulting from the new bridge project in accordance with the National Environmental Policy Act (NEPA), and as part of the Federal permitting process for the project, has identified the need for the County to make efforts to mitigate the project's impact on navigation of existing vessels.
  • The owner and the County have agreed to mitigate the impact of the vessel by selling the vessel to the County.
  • The agreed upon price is $5,500 and was based upon comparable sales of similar sailboats.

Please return original, signed Agreement and Title to the Public Works Department, attention Kent Bontrager, P.E., Sr. Project Engineer.  Please call Mr. Bontrager at 941-708-7331 and he will pick up the signed documents.

Manatee County Public Works Fiscal staff will remit payment to Mr. Caruso once a fully executed agreement is received.
