Reduction of Code Enforcement Fines for David & Barbara Marlow, Case CE2010110183

Action Requested
Motion to reduce the fines for this case to $100.00 plus $20.00 in recording fees, as previously recommended by the Special Magistrate on September 25, 2019, subject to the following conditions:
  1. The reduced fine shall be paid within 90 days or will revert to the original fine amount of $5,250.00.
  2. Recording fees shall be paid which total $20.00.
  3. Building and Development Services Department Director is authorized to sign Satisfaction of Liens if the reduced fines are paid.

Background Discussion
The owners, David and Barbara Marlow, were cited for having a shed on their property without the required building permit or Certificate of Completion.  Mr. & Mrs. Marlow had hired a contractor to complete the work, who, they discovered, was later disciplined by the Construction Trades Board.  They were unaware that the permit pulled by the contractor had expired until receiving a Notice of Violation on 12/21/10.  Mr. & Mrs. Marlow worked closely with the Building Department and Code Enforcement to bring the property into compliance, and are respectfully requesting that the fines be mitigated.   

Violation:  Sections 512.1 and 513 of the Land Development Code

  1. Notice of Violation was issued on December 21, 2010.
  2. The Special Magistrate Hearing was held on February 23, 2011.  The property owner was ordered to comply on or before March 18, 2011, for Section 512.1 and August 19, 2011, for Section 513, or a minimum fine of $150.00 plus $100.00 per day would be imposed for each violation.  
  3. Complied:  May 9, 2011.
  4. The Special Magistrate Hearing was held on September 25, 2019.  The Magistrate determined that justification exists to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount to $120.00 to settle this case.  Staff supports this recommendation.
