Sidewalk Agreement with Taylor Morrison of Florida, Inc., for "Azario" f/k/a Lakewood Ranch 1000

Action Requested
Authorization for the Chairperson to execute the Sidewalk Agreement between Manatee County and Taylor Morrison of Florida, Inc. allowing Taylor Morrison (the Developer) to satisfy the obligation to construct a sidewalk along portions of Lorraine Road right-of-way along the western boundary of the property through a payment-in-lieu of construction.

Enabling/Regulating Authority
Section 1001.6.A.1.a of the Manatee County Land Development Code requires construction of a sidewalk along both sides of a major thoroughfare.

Background Discussion
Taylor Morrison of Florida, Inc. received approval for the development of certain property (Exhibit "A") for the construction of "Azario, f.k.a Lakewood Ranch 1000" (the Project) as part of the approval of Manatee County Ordinance PDR-17-34(Z)(G).  As part of the Ordinance, the Developer requested and received specific approval for alternative to the Land Development Code Section 1001.6.A.1.a, requiring the construction of a sidewalk along the western boundary of the project, adjacent to Lorraine Road.  The Developer is now seeking to enter into a payment-in-lieu of construction agreement for the sidewalk, "Sidewalk Agreement" as depicted in exhibit "B" of the agreement. 

As depicted in Exhibit "B" of this agreement, the Developer has opted to make a payment-in-lieu of constructing approximately 2,407 linear feet of a five-foot-wide concrete sidewalk and required ADA ramps and curb transitions.  The Developer has submitted an itemized cost estimate for construction of 2,407 linear feet of a five- foot-wide concrete sidewalk and AD ramps and curb transitions in the amount of $60,283.33.  See Exhibit "C" - Cost Estimate. 

The Office of the County Attorney has reviewed this "Sidewalk Agreement" and referenced exhibits "A", "B", and "C".  Staff has reviewed and approved the cost estimate quantities and values.
