Background Discussion

The Aviary at Rutland Ranch is approximately 400 acres located 1,800 feet east of 161st Avenue East and North of CR675 at 16410 CR 675 in Parrish.  The site was rezoned to Planned Development Residential on January 3, 2013, with the approval of a General Development Plan for 784 residential units (PDR-12-03(Z)(G)).  A Preliminary Site Plan was approved by staff on February 24, 2015, for 784 residential units.

A Local Development Agreement for the Aviary (LDA-14-03) was approved on April 21, 2015, and has an effective date of May 23, 2015.  The agreement included terms related to wastewater connections, wastewater line capacity fees, and dedication of road right-of-way.  Related to a proposed alternative connection to the wastewater system, the applicant committed to obtain first final site plan and construction plan approvals for development within twenty-four (24) months of the effective date of the agreement.  The request is for approval of an amendment to the existing Local Development Agreement. 

The specific change is an extension of the date for final site plans (FSP)  approval for the portion of the project  identified as Phase 1 (215 lots) including all necessary construction plan approvals to thirty-six (36) months of the original effective date of the LDA.  The proposed change has the effect of allowing the FSP and associated construction plans to be approved as late as May 2018.  The amendment also acknowledges site plan approvals and line extension fees paid to date.

The following activities have been undertaken to date:

  • The engineering design and construction plan have been completed and submitted to the County for review.
  • The Construction plans and Final Site Plan (FSP) have been submitted for the portion of the Project identified as Phase 1 (215 lots).

This is the first of two required public hearings.  The second hearing is scheduled for August 22, 2017.
