Interlocal Agreement--Self-Insured Health Plan

Action Requested
Approve attached Interlocal Agreement confirming that Constitutional Officers and other smaller groups participate in the Board's self-insured health plan.

Background Discussion

Florida Statutes authorizes local government to enter into a risk management consortium to provide health coverage to each such unit.  Manatee County has created, funded and sponsored, and operated the YourChoice Health Plan where the following groups have participated for some time:  Manatee County Sheriff, Manatee County Port Authority, Sarasota/Manatee Metropolitan Planning Organization, Manatee County Tax Collector, Manatee County Property Appraiser, Manatee County Housing Authority, Manatee County Clerk of Court, and Manatee County Supervisor of Elections. 

The Affordable Care Act (ACA) drastically revises how health insurance is provided to citizens and how certain health plans must operate and provides for a significant "per employee" financial penalties for failure to comply with a variety of its terms.  This consortium agreement solidifies that participating parties agree to comply with the Employer Mandate rules of the ACA related to the health plan in order to avoid significant penalties to the County. 

It does not appear from historical County Commission records that the local government units currently participating have actually entered into a formal consortium agreement as contemplated in the statute.  Therefore, all participating are in agreement that it is in their mutual benefit to memorialize and continue to participate in a consortium so as to achieve the most beneficial health care benefits at costs substantially below what similar benefits would cost if procured by other means.
