Reduction of Code Enforcement Fines for Pier Carlo Porta, Case No. CE2013050680

Action Requested
Motion to reduce the fines for this case to $2,500.00 plus $40.00 recording fees, as previously recommended by the Special Magistrate on July 22, 2020, subject to the following conditions:
  1. The reduced fine shall be paid within 90 days or will revert to the original fine amount of $15,150.00.
  2. Recording fees shall be paid which total $40.00.
  3. Building and Development Services Director is authorized to sign Satisfaction of Liens if the reduced fine is paid.

Background Discussion

The owner, Pier Carlo Porta, was cited for installing a new water heater, siding, and new roof without the required Building Permit and Certificate of Completion.  Mr. Porta resides in Italy and had a gentleman here in the states assisting him with the renovations of the house.  The contractors who performed the work did so without the required permits.  Mr. Porta alleges, he was not notified by his contact here regarding the violations and did not know that fines had accrued on the property.  The representative, Cheryl D'Aloia, is respectfully requesting that the fines be mitigated.

Violation:  Section 512.1 and 513.1 of the Land Development Code


  1. Notice of Violation was issued July 18, 2013.
  2. The Special Magistrate Hearing was held on September 25, 2013.  The property owner was ordered to comply on or before October 18, 2013 for Section 512.1 and November 22, 2013 for Section 513.1 or a minimum fine of $100.00 per violation and a daily fine of $50.00 per violation would be imposed.
  3. Complied:  April 4, 2014 Section 512.1 and May 1, 2014 Section 513.1
  4. The Special Magistrate Mitigation Hearing was held July 22, 2020.  The Magistrate determined that justification exists to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount to $2,500.00 plus $40.00 in recording fees to settle this case.  Staff supports this recommendation.
