Interlocal Agreement with School Board providing for an Impact Fee Study

Action Requested
Authorize the Chairman to sign the Interlocal Agreement between Manatee County and the School Board of Manatee regarding Levy and Collection of School Impact Fees.

Background Discussion

This interlocal agreement between the Manatee County Board of Commissioners and the School Board of Manatee County provides a formal framework for the School Board to conduct an impact fee study for schools and lays out a process for the possible reinstatement, levy, collection, and use of the proceeds of a School Impact Fee.

The School Board approved this Interlocal Agreement at their Board meeting on April 14, 2015.

Manatee County is currently in the process of engaging an impact fee consultant to update all of the county's impact fees.   The School Board also desires to conduct an impact fee study for schools for the possible reinstatement of a school impact fee.   Staff from both agencies believe there are efficiencies, cost savings, and other advantages to hiring a single consultant to perform all the studies.

Major provisions of the Interlocal Agreement include:

  • Impact Fee Study - The County will contract for an impact fee consultant to perform a study for the county's various impact fees as well as a separate task to do a study for the school component.   The School Board will reimburse the County for the cost of doing the school impact fee component.  The School Board will also provide necessary data, information, staff  input, and analysis to the consultant to facilitate completion of the School Impact Fee study.


  • Process for Consideration of the School Impact Fee Study - Upon completion of the School Impact Fee Study, the School Board will consider (within 90 days) at a public meeting whether or not to transmit the School Impact Fee Study to the County and provide a statement of support for the reinstatement, levy, and collection of the School Impact Fee.  If transmitted by the School Board, the County Planning Commission and Board of County Commissioners would then consider whether to impose the School Impact Fee and the rate at which it would be levied.
