Enabling/Regulating Authority
Manatee County Land Development Code, Chapter 11, Section 1106 Credits Against Impact Fees.

Background Discussion

Manatee County Land Development Code, Chapter 11, Section 1106 Credits Against Impact Fees provides for authorization by the Board of County Commissioners for Impact Fee Credits for contributions, payment, construction, or dedications made to Manatee County against applicable components of impact fees.

An Agreement between Centex Homes and Manatee County, dated August 7, 2007, agreed the park acreage conveyed to the County was sufficient to meet the Park Site requirement. The Agreement also authorized Centex Homes to request Parks and Natural Resources Impact Fee Credits for constructing improvements on the park site known as Creekwood Park.

The Credit Authorization #CA-08-04(P) for improvements at Creekwood Park was approved by the Board of County Commissioners on July 25, 2017.

Manatee County Parks and Natural Resources Department reviewed and accepted the cost of the park improvements.

The Creekwood Park improvements include a pavilion, restrooms, playground, trail, dog park and typical park amenities such as landscaping, benches, sidewalks and parking.

Staff requests the Board of County Commissioners approve the Final Authorization of Parks and Natural Resources Impact Fee Credit #CA-08-04(P) for the completion of the park site improvements in the amount of $814,765.45.

Approval of the Final Authorization will allow owner/developer to receive Parks and Natural Resources impact fee credits as requested.

Centex Homes has also agreed to assign the balance of their credits to Pulte Home Company, LLC, in the amount of $401,290.00 and Divosta Homes, L.P., in the amount of $413,475.00   Centex Homes has provided the County with  notarized assignments authorizing the transfer of these credits to Pulte Home Company, LLC, and Divosta Homes, L.P.  Staff therefore recommends that a new impact fee credit authorization, CA-08-04(P)(R) and CA-08-04(P)(R2), be established to assign the specified amounts of Parks and Natural Resources impact fee credit to Pulte Home Company, LLC, and Divosta Homes, L.P.  The newly-assigned credit will be authorized for use only for Parks and Natural Resource impact fees.
