Action Requested

Adoption of Resolution R-14-122 amending the 28th Avenue East Street Lighting MSBU from $85.00 per parcel per year to $68.00 per parcel per year.



Enabling/Regulating Authority

Chapter 125.01 (Q), Florida Statutes, provides for the establishment of a MSBU and provides that the BCC shall be the governing Board of any MSBU created.

Chapter 125.01 (R), Florida Statutes, provides for the County to levy, collect, and enforce special assessments within a MSBU.

Chapter 197.3632, Florida Statutes, provides for the use of the Uniform Method for the levy, collection, and enforcement of Non-Ad Valorem Assessments.



Background Discussion
  • December 19, 2005, a petition was submitted from 64% of the property owners on 28th Avenue East, 6th Street East, 6th Street Court East and 7th Street East requesting a MSBU for Street Lighting.

  • May 22, 2006, a First Public Information Meeting was held with the property owners to discuss the proposed MSBU for Street Lighting.

  • June 2, 2006, letters were mailed to the property owners along with a postcard.   The purpose of the postcard was to enable each property owner to register whether they were in favor of, or opposed to, the proposed MSBU for Street Lighting on 28th Avenue East, 6th Street East, 6th Street Court East and 7th Street East.

    The results of the postcard poll were as follows:

    In Favor:  56 = 75%
    In Opposition:  3 = 4%
    No Response:  16 = 21%

  • June 20, 2006, the BCC authorized setting a Public Hearing to consider creating a MSBU for Street Lighting on 28th Avenue East, 6th Street East, 6th Street Court East and 7th Street East.

  • July 25, 2006, the BCC adopted Ordinance 06-52 which established a Street Lighting MSBU on 28th Avenue East, 6th Street East, 6th Street Court East and 7th Street East.  The annual assessment associated with this MSBU of $134.38 per parcel per year was calculated by determining the costs over the immediate preceding 12 month period, and included the Florida Power and Light charges, Property Appraiser and Tax Collector Fees and Indirect Costs.

  • September 11, 2007, the BCC adopted Resolution R-07-169 which amended the 28th Avenue East, 6th Street East, 6th Street Court East and 7th Street East Street Lighting MSBU by decreasing the assessment from $134.38 per parcel per year to $61.00 per parcel per year.

  • Over the years, there have been discussions regarding indirect costs and the need to change the assessment so often.  In 2008, it was determined that indirect costs would be based on the actual cost of Utilities; however this approach was not feasible due to the fact that the Utilities were different for all projects.

  • In 2009, indirect costs were re-evaluated.  Based on that re-evaluation, it was determined that indirect costs would be uniformly calculated for all street lighting projects as follows:

    1st Year = Flat fee of $1,000 + $5.00 per parcel
    2nd Year & All Subsequent Years = $500 + $5.00 per parcel

  • Since we were changing the methodology for calculating indirect costs, Public Hearing were conducted on all twelve street lighting projects on August 25, 2009.  The assessment was decreased in seven projects, the assessment remained the same in three projects and the assessment was increased in two projects, one of them being 28th Avenue East, 6th Street East, 6th Street Court East and 7th Street East.

  • August 25, 2009, the BCC adopted Resolution R-09-064 which amended the 28th Avenue East, 6th Street East, 6th Street Court East and 7th Street East Street Lighting MSBU by increasing the assessment from $61.00 per parcel per year to $85.00 per parcel per year.

  • The Financial Department has determined that the assessment for 28th Avenue East, 6th Street East, 6th Street Court East and 7th Street East needs to be decreased from $85.00 per parcel per year to $68.00 per parcel per year. 

  • It is anticipated that this assessment of $68.00 per parcel per year will remain consistent for a number of years.  However, we cannot predict substantial increases of decreases on the cost of Utilities imposed by our electric Companies.
