Action Requested
Authorization for the County Administrator to execute the "Road Improvement and Sidewalk Agreement" required of the "Developer", Pulte Home Corporation, for the "project"  Del Webb at Lakewood Ranch.   

Enabling/Regulating Authority
Section 722.1.4.1 of the Land Development Code requiring construction of a sidewalk adjacent to a Major Thoroughfare.

Background Discussion

The "Developer", Pulte Home Corporation, is the developer of that certain project in Manatee County, FL referred to as Del Webb at Lakewood Ranch ("Project"), which project is located on the real property described on Exhibit "A",  ("Property") of the attached agreement.

The BOCC passed and approved Zoning Ordinance PDR-13-38 (Z) (G) ("Zoning Ordinance"), rezoning the Project to PDR/WP-E/ST and approving a General Development Plan ("GDP") for the project.

The Zoning Ordinance also granted Specific Approval for an alternative to the Land Development Code ('LDC") Section 740.3.1 and section 740.2.6.11 relating to minimum pavement width for private streets because the proposed streets within the project do not meet current County standards for travel lane width; and

Stipulation A.3 of the Zoning ordinance required the Developer and the County to enter into an agreement to address: (a) potential future conversion of the internal streets from private to public and the requirements for internal streets to meet County standards as a  condition of Manatee County's acceptance of dedication, and (b) the construction of a sidewalk, or payment in lieu of construction of a sidewalk, along S.R. 70 the entire length of the Property.

The Developer has elected not to construct the Side Walk along S.R. 70 in anticipation of FDOT potentially constructing the same as part of future road widening.

The attached agreement is for all sections, "A", "B" and "C" of the Development, Del Webb at Lakewood Ranch and the sidewalk length along this phases.  Initially funds, as per Section "B' Cost Estimate, the present phase, will be collected once agreement is executed, prior to platting.  As each future phase undergoes the platting process the remainder of the payment will be submitted.

Staff have reviewed the total length of side walk required and the associated cost estimate and are in agreement with the estimate.
