FORM OF MOTIONS:

Adoption of Resolutions R-13-166, R-13-168, R-13-170, R-13-172, and R-13-179, determining public purpose and necessity for the acquisition of certain parcels of privately owned realty, as related to the proposed improvements to 44th Avenue East Road Improvement Project from 30th Street East to 45th Street East.

Adoption of Resolutions R-13-167, R-13-169, R-13-171, R-13-173, and R-13-180, authorizing the use of eminent domain "quick take" proceedings in the acquisition of certain parcels of privately owned realty, as related to the proposed improvements to 44th Avenue East Road Improvement Project from 30th Street East to 45th Street East.

Background Discussion

Manatee County proposes to improve 44th Avenue East from 30th Street East to 45th Street East.  This project is a CIP-approved project.

 

The County has previously notified the fee owners and the business owners of their rights and obligations pursuant to Section 73.015, Florida Statutes.  The time period by which the County must wait in order to file suit has expired.  The Property Acquisition Division has requested the County Attorney's Office to commence and prosecute eminent domain proceedings in order to acquire the remaining necessary interests.

 

The owners of the land to be acquired is as follows:

 

Parcels 109A, 109B, and 109C:

Owner:  Keeping Kids in Their Home Foundation Corp., as Trustee for Abundant Life Trust

Interest to Be Acquired:  Fee Simple Interest

Appraised Value:  $471,800

 

Parcel 113:

Owner:  Deloy P. Dahlman, Sr.

Interest to Be Acquired:  Fee Simple Interest

Appraised Value:  $48,200

 

Parcels 115A and 115B:

Owners:  Sue P. Kish

Interest to Be Acquired:  Fee Simple Interest

Appraised Value:  $136,100

 

Parcel 121

Owners:  Morris H. Griggs and Anginette Griggs

Interest to Be Acquired:  Fee Simple Interest

Appraised Value:  $113,600

 

Parcel 800

Owner:  Stanley R. Fleck

Interest to Be Acquired:  Perpetual Easement

Appraised Value:  $200
