Action Requested
Execution of Contract for Sale and Purchase for a Warranty Deed from Fairfax Homeowners Association, Inc., in the amount of $35,000.00 to acquire property for 45th Street East road improvements from 44th Avenue East to State Road 70 Project.

Enabling/Regulating Authority
Florida Statute Chapters 125 and 127.  Manatee County Comprehensive Plan Goal 5.1 addresses the safety and efficiency of forecasted vehicular demands.

Background Discussion
  • The 45th Street East from 44th Avenue East to State Road 70 road improvement project #6025662 was approved in the FY2013-2017 CIP.
  • Parcel 111 is a 2,769 square foot vacant common area located at 4425 Fairfax Drive East, Bradenton, Florida 34203.  
  • On March 28, 2015, State Certified General Real Estate Appraiser Philip R. Hobby of Independence Acquisition & Appraisal, LLC, determined the value of the parcel to be acquired at $32,900.00
  • Market Value for the fee simple acquisition of the land area is allocated as follows; $16,700.00 land, $8,800.00 improvements for a portion of a landscaped island, and $7,400.00 net cost to cure damages.
  • A proposed settlement was reached in the amount of $35,000.00 to avoid litigation and eliminate potential costs for expert witness and attorney's fees.
