Background Discussion

On June 2, 2015, the Board of County Commissioners approved Ordinance No. 15-22 which amended provisions of Article VIII of Chapter 2-31 of the Manatee County Code of Ordinances pertaining to facility investment fees for the public utilities system.  The amendments also addressed sections of the Code providing for time payment agreements and potable water reserve capacity with respect to facility investment fees.

Attached is a copy of Ordinance No. 15-39 amending provisions of Article IX of Chapter 2-31 of the Manatee County Code of Ordinances relating to rates, fees, and charges for the public utilities system.  This ordinance revises the following provisions of the Code of Ordinances:

  • Subsection 2-31-256(d) is modified to incorporate the same language concerning time payment agreements for connection fees and line fees or line extension fees as contained in Ordinance No. 15-22 applicable to facility investment fees.
  • Subsection 2-31-264(c) regarding adjustments is revised to correct a typographical error by the codification service.
  • Paragraph 2-31-265(a)(1) is amended to include the same potable water reserve capacity for Sarasota County as set forth in Ordinance No. 15-22.

The effective date of Ordinance No. 15-39 is October 1, 2015, for consistency with Ordinance No. 15-22.
