Authorization to set public hearings on Land Development Code changes and Procedures Manual related to Impact Fees

Authorization for staff to schedule and legally advertise public hearings to consider changes to the Land Development Code (LDC) regarding impact fees (Chapter 11) and definitions (Chapter 2). The public hearings will also consider adopting, by resolution, an Impact Fee Administrative Procedures Manual. LDC changes include housekeeping updates, expenditure of "old money" within cities, and capping County impact fees at 90%.

In April and May the Board held two work sessions on impact fees. The general direction provided to staff was to draft LDC changes that would allow impact fees collected prior to 4/18/16 to be spent within cities. The Board also directed staff to publicly share draft LDC changes necessary to implement the Action Plan from the Clerk's audit, along with housekeeping updates to achieve consistency between the LDC and Impact Fee Study. Board directed staff to schedule deliberation on whether impact fees for County facilities should remain capped at the current level, which is 90% of the fee schedule documented in the 2015 Impact Fee Study.
