Action Requested

RECOMMENDED MOTION:

Based upon the staff report, evidence presented, comments made at the Public Hearing, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, I move to recommend ADOPTION of Manatee County Zoning Ordinance No. Z-17-04, as recommended by staff.

Background Discussion

• Lenworth and April Dacas, applicants, are requesting approval of a rezone for approximately 2.569± acres of land located north of 37th Avenue East approximately 175 feet east of 9th Street East.
• The site consists of two parcels in the RSF-4.5 (Residential Single Family – 4.5 dwelling units per acre) zoning district with a request for the parcels to be rezoned to the RDD-4.5 (Residential Duplex Development – 4.5 units per acre) zoning district.
• The current zoning district RSF (Residential Single Family) is intended to provide for residences in a suburban environment at low to medium densities.  The proposed RDD (Residential Duplex) zoning district provides for medium density residential uses, including single –family and duplex development.
• The site is within the RES-9 (Residential -9 dwelling units per acre) future land use category which lists suburban or urban residential uses in the range of potential uses.
• The site consists of one single family dwelling unit. The potential maximum number of dwelling units on the project site is 11 which includes a potential maximum of 2 dwelling units on parcel 4805700004 and a potential maximum of 9 dwelling units on parcel 48059000000.
• The site is located on a residential street and there are sidewalks in front of the site.
• A straight rezone can’t condition uses and design standards.  Compliance with the standards of the RDD-4.5 zoning district and all other requirements of the LDC will be reviewed and verified with future site plan approval for this site.
• Staff recommends approval.
