  • Execution of Contract for Sale and Purchase with David Kilgour, Jr. and Mary Jo Kilgour for the purpose of the Ellenton Gillette Road Functional Improvement Project (U.S. 301 to Moccasin Wallow Road) in the amount of $56,000.00.


Enabling/Regulating Authority
Chapters 125 and 127, Florida Statutes.  Manatee County Comprehensive Plan Goal 5.1 addresses the safety and efficiency of forecasted vehicular demands.

Background Discussion

The Ellenton Gillette Road Functional Improvement Project from U.S. 301 to Moccasin Wallow Road was approved in FY 2013-2017 CIP 309-6084560.

Parcel 8 is improved with a single-family residence that is owner occupied located at 8410 36th Avenue East.  The project requires a partial take of 3,979 square feet.  On June 11, 2015, Appraiser Steve Cross, SR/WA, of RTD Group, LLC, determined the value of the area for acquisition at $14,100.00. 

The homeowners were worried the County's third party contracted acquisition agent and appraisal did not fully address their concerns and no agreement was reached between the parties.

David Kilgour and Mary Jo Kilgour, the homeowners, retained attorney Jim Helinger Jr. with Helinger and DeYoung.  Public Works determined that the project now requires a reduced right-of-way acquisition of 35 feet instead of the previous 55 feet for this parcel.  The Ellenton Gillette road improvement traffic circulation plan reflects a four lane arterial roadway to be constructed.  This reduced take of 3,979 for parcel 8 will lessen the impact to the homeowners improvements.

A settlement was reached at $56,000.00 for a partial property acquisition as full compensation and includes legal costs.

This settlement eliminates additional costs for litigation fees or expert fees associated with this agreement.
