Action Requested

Execution of a Contract for Sale and Purchase for a Temporary Construction Easement with Oneco Associates, LLC, for constructing the adjacent improvements, tying in and harmonizing to 44th Avenue East and 12th Street Court.



Enabling/Regulating Authority
Chapters 125 and 127, Florida Statutes, Comprehensive Plan, Goal 5.1 addresses the safety and efficiency of forecasted vehicular demands.

Background Discussion

The original 44th Avenue East (US 41 - 15th Street East) Road Right of Way Improvement Project was approved in the FY 1994/1995 CIP on February 25, 1994, and re-approved in FY 2009/2010 CIP on September 15, 2009, with Resolution R-09-219.

This contract is for an extension of a Temporary Construction Easement for three (3) years.  The previous Temporary Construction Easement (O.R. 2341, Page 5495) expired on June 9, 2012.

On October 13, 2009, Shawn E. Wilson, MAI, of Compass Real Estate Consulting, Inc., determined the total appraised value of the parcel to be $600.00 for a term of 2 years.  Specifically, the total consists of the following; $500.00 for 250.5 square feet of land and $100.00 for improvements.

A negotiated settlement was agreed upon for a total amount of $1,500.00 for a Temporary Construction Easement. The purchase price is a negotiated figure representing a litigation avoidance settlement which eliminates additional costs for litigation fees for attorneys, property appraisers, land planners, engineers, and surveyors.
