Background Discussion

On October 7, 2014, Manatee County executed Amendment No. 1 to the Solid Waste Franchise Agreements with Waste Pro of Florida, Inc., and Waste Management Inc. of Florida.  Amendment No. 1 renews and extends the Solid Waste Franchise Agreements for residential and commercial collection of solid waste, recyclable materials, and yard trash in unincorporated Manatee County through September 30, 2023.

Section 3.1 of Article 3 of the Solid Waste Franchise Agreements provide for adjustments in the payments made to the authorized collectors, including an annual service fee adjustment based on percentage changes in the Consumer Price Index (CPI) and Fuel Index.

Chapter 2-16 of the Manatee County Code of Ordinances requires the Board of County Commissioners to hold a public hearing in accordance with applicable laws to establish or change rates, fees, and charges for solid waste collection and disposal services.  Prior to September 22, 2015, the most recent changes to rates, fees, and charges under the Franchise Agreements were adopted by the Board in Resolution No. R-11-221 on October 25, 2011.

Attached is a copy of Resolution No. R-15-161 providing for annual review and consideration of solid waste rates, fees, and charges for the remainder of the term of the Solid Waste Franchise Agreements, as amended by Amendment No. 1.  This resolution establishes the following process:

  • The County Administrator annually reviews the rates, fees, and charges for collection and disposal services in accordance with the costs and expenses of the solid waste system, based on the Solid Waste Franchise Agreements, as amended by Amendment No. 1, and Section 2-16-56 and Chapter 2-16 of the Manatee County Code of Ordinances.
  • The County Administrator makes recommendations to the Board of County Commissioners regarding establishment or change of rates, fees, and charges for solid waste collection and disposal services, if deemed necessary based on the annual review.
  • The County Administrator's recommendations are presented to the Board of County Commissioners for discussion at a meeting or work session.
  • If directed by the Board of County Commissioners, a resolution establishing or changing rates, fees, and charges for solid waste collection and disposal services is prepared and a notice of public hearing is published in a newspaper of general circulation.
  • The Board of County Commissioners holds a public hearing in accordance with applicable laws to consider the resolution establishing or changing rates, fees, and charges for solid waste collection and disposal services.
