FORM OF MOTION:

Motion to:

  1. Adopt Resolution R-17-108, determining public purpose and necessity for the acquisition of certain parcels of privately owned realty, as related to the proposed improvements to 44th Avenue East from 45th Street East to 44th Avenue Plaza East; and
  2. Adopt Resolution R-17-109, authorizing the use of eminent domain “quick take” proceedings in the acquisition of certain parcels of privately owned realty, as related to the proposed improvements to 44th Avenue East from 45th Street East to 44th Avenue Plaza East.

Background Discussion
Manatee County proposes to improve 44th Avenue East from 45th Street East to 44th Avenue Plaza East.  This project is a CIP-approved project.
 
The County has previously notified most of the fee owners and the business owners of their rights and obligations pursuant to Section 73.015, Florida Statutes.  The time period by which the County must wait in order to file suit has expired on most of the parcels.  The Public Works Department has requested that the County Attorney's Office commence and prosecute eminent domain proceedings in order to acquire the remaining necessary interests.
