FORM OF MOTIONS:

Adoption of Resolutions R-13-143, R-13-145, and R-13-147, determining public purpose and necessity for the acquisition of certain parcels of privately owned realty, as related to the proposed pedestrian sidewalk improvements along Morgan Johnson Road.

Adoption of Resolutions R-13-144, R-13-146, and R-13-148, authorizing the use of eminent domain "quick take" proceedings in the acquisition of certain parcels of privately owned realty, as related to the proposed pedestrian sidewalk improvements along Morgan Johnson Road.

Background Discussion

Manatee County proposes to construct pedestrian sidewalk improvements along Morgan Johnson Road.  This project is a CIP-approved project.

The County has previously notified the fee owners and the business owners of their rights and obligations pursuant to Section 73.015, Florida Statutes.  The time period by which the County must wait in order to file suit has expired.  The Property Acquisition Division has requested the County Attorney's Office to commence and prosecute eminent domain proceedings in order to acquire the remaining necessary interests.

The owners of the land to be acquired is as follows:
 
Parcel 801:
Owner:  U.S. Bank National Association, as Trustee for the Holders of Bear Stearns Asset Backed Securities I Trust 2006-IM1, Asset-Backed Certificates Series 2006-IM1
Interest to Be Acquired:  Pedestrian Sidewalk Easement
Appraised Value:  $5,050

Parcel 807:
Owner:  Braden River Industries, Inc., a Florida corporation
Interest to Be Acquired:  Pedestrian Sidewalk Easement
Appraised Value:  $9,100

Parcel 808:
Owners:  James K. Toomey and Loriann M. Toomey, husband and wife
Interest to Be Acquired:  Pedestrian Sidewalk Easement
Appraised Value:  $10,500

Specific information on the appraised values of the land to be acquired can be provided at the time of presentation of this matter, if the Board so desires.
