RECOMMENDED MOTION:

Based upon the staff report, evidence presented, comments made at the Public Hearing, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, I move to ADOPT Manatee County Zoning Ordinance No. PDC-05-67(P)(EXT 3) to extend the Preliminary Site Plan for two (2) years from October 14, 2017 to October 14, 2019, as recommended by staff.

Background Discussion

• Mark P. Barnebey, Esquire, Blalock Walters Attorneys at Law, agent for the owner, is requesting a Land Development Code, Section 322.5, extension for a Preliminary Site Plan (PSP) for a period of two (2) years from October 14, 2017 to October 14, 2019.

• The request is for a Land Development Code (LDC) based, Board granted extension of the expiration date for a Preliminary Site Plan (PSP).   The PSP was originally approved by the BOCC in December 2008 (PDR-05-67(Z)(P)) and is approved for 196 single family attached units.   Two previous extensions have been granted:  HB503 granted in which extended the site plan approval to December 5, 2015 and Tropical Storm Ericka which extended the site plan approval to October 14, 2017.

• Staff reviewed the future land use and zoning to determine if any change to adjacent properties has occurred that would render the existing PSP inconsistent and staff’s review concluded that nothing has occurred since the original PSP adoption that would render the approved PSP inconsistent.

• Staff supports the request for a two (2) year extension of the Preliminary Site Plan.
