RECOMMENDED MOTION:

Based upon the staff report, evidence presented, comments made at the Public Hearing, the action of the Planning Commission, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, as conditioned herein, I move to APPROVE Manatee County Zoning Ordinance No. PDR-15-29(Z)(P); APPROVE the Preliminary Site Plan with Stipulations A.1-A.5, B.1-B.5, C.1-C.6, and D.1-D.7; GRANT Special Approval for a project: 1) partially within a designated Entranceway, 2) adjacent to perennial stream, and 3) with habitable structures located within the 25-year floodplain; ADOPT the Findings for Specific Approval; and GRANT Specific Approval of an alternative to Land Development Code Sections 402.7.D.5, and 701.3.B.3.c (Eliminate a portion of required 15-foot greenbelt buffer), as recommended by the Planning Commission.

Background Discussion

• Mr. Donald A. Neu, AICP, NEUMORRIS Consulting, LLL, agent for the property owner, is requesting approval of a rezoning from A-1 (Suburban Agriculture) to PDR (Planned Development Residential) and a Preliminary Site Plan for 187 lots for single-family detached residences.

• The 60.1± acre vacant site is located on the east side of 36th Avenue East (Ellenton-Gillette Road), and south of 89th Street East (Amlong Road), Palmetto. The site is within the RES-6 (Residential – six dwelling units per acre) Future Land Use Category (FLUC), and partially in a designated Entranceway of the County (I-275 Corridor – approximately 8 acres).

• The Preliminary Site Plan proposes:

      o Two access points, along Ellenton-Gillette Road and Amlong Road.
      o 24 feet wide internal roadways (50-foot wide public right-of-way). No inter- neighborhood tie is proposed. 
      o A minimum lot size of 6,000 sq. ft. (50’ x 120’). 
      o Gross Density: 3.11 du/acre and Net Density: 3.18 du/acre.
      o A 20-foot wide roadway buffer (along Ellenton-Gillette Road, Amlong Road, and platted R-O-W), and 20-foot wide greenbelt landscape buffer along property boundaries. 
      o 5-foot wide sidewalks on one side of the internal roadway network, and 5-foot wide exterior sidewalk along Ellenton-Gillette Road and Amlong Road. 
      o Impacts to wetland (0.02 aces). Wetland impacts mitigation is provided. 
      o 33% of the site is designated as open space (20.07 acres) exceeding the minimum requirement for a Planned Development Residential project partially located within an Entranceway (overall requirement 25.67%).
      o Keeps the current location of an existing 190 foot height personal wireless communication tower on the southwest portion of the site. Residential lots will be located outside of the fall-down radius of the tower (100 feet) in compliance with LDC Section 531.37.D.4.b.
      o A park has been proposed as neighborhood focal point. No recreational acreage is provided.

• Special Approval is required for adjacent to a perennial stream (Cabbage Slough), partially located within a designated Entranceway of the County (I-275 Corridor), and with habitable structures located within the 25-year floodplain.

• Specific Approval is requested to LDC Section 402.7.D.5 and 701.3.B.3.c, to eliminate a portion (160 feet in length) of the required 15-foot wide greenbelt buffer adjacent to a 20-foot drainage easement. 

• Staff recommends approval.

• On July 14, 2016, by a vote of 4 – 3, the Planning Commission recommended approval. Mr. Rutledge, Mr. Bower, and Mr. Horrigan voted nay due to compatibility issues with existing neighborhood.

• On August 4, 2016, by a vote of 5 – 2, the Board of County Commissioners continued the public hearing to October 6, 2016.

• After the August 4, 2016 Board of County Commissioners public hearing the applicant submitted a revised Preliminary Site Plan that proposed to:

      o Reduce the total number of lots from 187 to 172 
      o Reduce the gross and net density from 3.11 du/acre and 3.18 du/acre to 2.86 du/acre and 2.93 du/acre respectively.
      o Increase the size of 43 lots from 6,000 square feet (50’ x 120’) to 8,400 square feet (70’ x 120’). The larger lots have been proposed along property boundaries that are adjacent to larger existing residential properties. 
      o Improve Amlong Road to County Standards from the westward project entrance to Ellenton-Gillette Road. The proposed improvements include widening pavement (24’ wide Right-of-Way), installation of a 5-foot wide sidewalk along the south of the road, and piping of drainage ditches where necessary for the improvements.  The referenced improvements are depicted on the Preliminary Site Plan, have been stipulated, and will be subject to review and approval at time of Final Site Plan/ Construction Plan submittal. 
      o Provide a 3-foot high berm along all buffers with planting on top of the berm to enhance landscaping and provide additional screening from adjacent properties.
