Background Discussion
Chapter 8, Section 807 of the Manatee County Land Development Code provides for authorization by the Board of County Commissioners of Impact Fee Credits for contributions, payments, construction, or dedications made to Manatee County against applicable components of impact fees.

Circle K Stores, Inc., has dedicated right-of-way on Moccasin Wallow Road, as was required by Manatee County Ordinance PDC-05-24(Z)(P).  That ordinance required Circle K to dedicate 55 feet of right-of-way as a condition of approval for a new store they were proposing to build at the corner of US 41 and Moccasin Wallow Road in northwestern Manatee County.

The ordinance also stipulated that Circle K would waive impact fee credits for the first 22 feet of right-of-way dedicated, and that they would limit the total amount of any credit they requested subsequent to the dedication to $55,408.   

Circle K completed the required dedication on June 12, 2013.  The dedication was accepted and recorded by Manatee County on August 13, 2013, in Official Records Book 2485, Pages 7298 - 7300.  The dedicated property is located in Impact Fee Roads Benefit District "NW."

As stipulated in ordinance PDC-05-24(Z)(P), the total amount of impact fee credit to be awarded for this dedication is $55,408.00.

This will be an allowable credit against road impact fees in Benefit District "NW" effective May 7, 2013.
