Authorize the County Administrator of his designee to execute the Guaranteed Maximum Price (GMP) Addendum to Agreement 13-2061DC, Construction Manager at Risk Services for Utilities Department Business Operations Facilities with Halfacre Construction Company of Sarasota, Florida, in the not to exceed amount of $1,815,763.16.

Manatee County Code of Laws
On June 17, 2014, the Board of County Commissioners approved Agreement 13-2061DC with Halfacre Construction Company to provide Construction Manager at Risk Services for the Utilities Department Business Operations Facilities. The Agreement established the Preconstruction Services Fee of $19,860.00. During the Preconstruction period, the Construction Manager at Risk shall establish a Guaranteed Maximum Price for the project which will be brought back to the Board of County Commissioners for approval in the form of an addendum to the Agreement.
On December 1, 2015, Amendment 1 to Agreement 13-2061DC was approved by the Board of County Commissioners which increased the Preconstruction Services Fee by the negotiated amount of $18,870.00, necessary as a result of County-initiated changes. Changes included increasing the square footage of one of the buildings by approximately 400 square feet to incorporate a secured water bill payment area and the relocation of the buildings from the back of the site to the road front.
Construction Manager at Risk (CM@R) services include value engineering, constructability, and life cycle cost analyses as well as development and maintenance of a project budget and scheduling and all other work necessary to reach final design to construct the facility within a Guaranteed Maximum Price (GMP). Pursuant to the terms and conditions of the Agreement, the Construction Manager has submitted a Guaranteed Maximum Price of $1,815,763.16.
The GMP shall constitute the guaranteed maximum price to be paid to the Construction Manager for all services rendered and all costs and expenses incurred in connection with the construction of the Project, such that Construction Manager shall constitute a Construction Manager at Risk, bearing all risk and responsibility for any costs exceeding the GMP.
As a guarantee for faithful performance of the Agreement, Construction Manager shall obtain, for the benefit of and directed to the County, a labor and material payment and performance bond satisfying the requirements of Section 255.05, Florida Statutes, guaranteeing the performance by Construction Manager of its obligations under the Agreement, including but not limited to the construction of the project and the payment of all obligations arising thereunder, including all payments to subcontractors, laborers, and material men.
